Each year, the U.S. Citizenship and Immigration Services opens approximately 140,000 employment based immigrant visas for qualified applicants worldwide. While there are five categories under which a foreign national may apply, the majority of applicants and approved visas fall within the EB2 and EB3 categories. To qualify for either of these visas, prospective employers must file an Immigrant Petition for Alien Worker Form I-140 with the USCIS.

EB2

Under the EB2 Immigrant Visa program, foreign nationals with advanced degrees or exceptional skills are allowed to apply for resident status in the U.S. Applicants for this visa must hold at least a Master’s degree or higher, must show they have exceptional ability to perform a specific job, and have active employment with company in the U.S. Applicants may also meet the requirements for this visa if they can show their skills and education will substantially benefit U.S. national interests.

EB3

Applicants under this type of visa fall under a more general employment criteria. There are three categories an applicant may fall under to qualify for anEB3 immigration visa: professional with a bachelor’s degree or higher and a current job offer with a U.S. company, skilled labor with at least two experience and a standing job offer, or unskilled with two years or less work experience with a current job offer.

Visa Application

Once the USCIS has reviewed the petition from the employer, the application will be sent to the National Visa for further processing. The applicant will then be notified of any additional documents including educational certificates, citizenship documents, or other civil documents which may be required.

Family Members

Successful applicants may apply for visas for their spouses and minor children under the age of 21. They will be required to provide the same civil documents as the applicant and upon approval their visa will provide the same rights and privilegesas the employment based visa holder.
